1. Acceptance of Terms

By accessing and using the PickStart platform ("Platform", "Service", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our Service.

2. Platform Description

PickStart is an educational platform that provides simulated sports picking environments for skill development and evaluation purposes. Our platform offers challenge accounts that allow users to practice sports picking using virtual funds in a controlled environment.

All picking activities are conducted using virtual funds and do not involve real money wagering related to actual sports outcomes. The Platform is designed for learning, practice, and evaluation purposes only.

3. Eligibility

To use our Service, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have the legal capacity to enter into binding agreements
  • Reside in a jurisdiction where use of our Service is permitted
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

We reserve the right to refuse service, terminate accounts, or restrict access to our Platform at our sole discretion.

4. Account Registration

To access certain features of our Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. Challenge Accounts

Our Platform offers various challenge account options with different parameters, including but not limited to account size, challenge type, and evaluation criteria.

By purchasing a challenge account, you acknowledge that:

  • All challenge account purchases are final and non-refundable
  • Challenge accounts use virtual funds for simulated sports picking
  • You must comply with all challenge rules and evaluation criteria
  • We reserve the right to modify challenge parameters with notice
  • Challenge accounts are subject to our evaluation and grading policies

5A. Grading, Errors, and Platform Discretion

All picks, results, grades, challenge outcomes, account balances, and evaluations on the Platform are subject to review and final determination by PickStart in its sole and absolute discretion.

In the event of any error, including but not limited to:

  • Incorrect lines, odds, spreads, totals, or market data
  • Incorrect pricing of challenge accounts or services
  • Data feed issues, system malfunctions, display errors, or latency
  • Human error, technical error, or third-party data inaccuracies

PickStart reserves the right to void, cancel, correct, re-grade, adjust, reverse, or remove any pick, result, challenge progress, account balance, or transaction, at any time, with or without notice.

Picks placed on clearly erroneous lines or pricing, or in circumstances where a reasonable user should have known an error existed, may be voided at PickStart's discretion.

PickStart's determinations regarding grading, errors, and corrections are final and binding. Users acknowledge that the Platform operates in a simulated environment and that displayed outcomes are not guaranteed to remain unchanged.

6. User Conduct

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Platform or servers
  • Attempt to gain unauthorized access to any part of the Platform
  • Use automated systems, bots, or scripts to interact with the Platform
  • Share your account credentials with others
  • Engage in any fraudulent, abusive, or harmful activity
  • Reverse engineer, decompile, or disassemble any part of the Platform

7. Payment Terms

All payments for challenge accounts must be made through our authorized payment processors. You agree to:

  • Provide accurate payment information
  • Authorize us to charge your payment method for purchases
  • Understand that all purchases are final and non-refundable
  • Comply with our payment processor's terms and conditions

All prices are displayed in USD unless otherwise stated and are subject to change without notice. In the event of a pricing error, PickStart reserves the right to cancel, void, or correct the transaction, including issuing a refund at its discretion.

8. Intellectual Property

The Platform and its content, including but not limited to text, graphics, logos, images, software, and other materials, are the property of PickStart or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Platform without our express written permission.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • That the Platform will be uninterrupted, secure, or error-free
  • That results from simulated sports picking reflect actual sports outcomes
  • Any guarantee of success or profitability

Displayed picks, results, and challenge progress may be corrected or modified due to errors or discrepancies and are not guaranteed to be final until confirmed by PickStart. The Platform does not provide financial advice and is intended solely for educational and evaluation purposes.

11. Limitation of Liability

To the maximum extent permitted by law, PickStart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenues, data, goodwill, or other intangible losses.

Our total liability for all claims arising from or related to your use of the Platform shall not exceed the amount paid by you to PickStart in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless PickStart, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Platform or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Violation of Platform rules
  • At our sole discretion

Upon termination, your right to use the Platform will immediately cease. Provisions that by their nature should survive termination shall survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on the Platform with an updated "Last Updated" date. Continued use of the Platform constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the appropriate courts.
